It is now January and theyve asked him various times to vacate. He refuses and my brother, just a 20 year old kid, does not know what to do. He spent $10,000 on the piece of land near my parents home and there is a trailor where the man is living. He now has the deed, what can he do with out spending a fortune on a lawyer??? We live in NY state. Thanks!

call the sheriff's department and they should be able to give you instructions on how to properly remove the person from your brother's property...

See what the police can do. They may decide that it's a trespassing issue.

uh...he needs to evict him assuming he has no rights to the property as a party in posession.

He's either going to try and DIY it at the clerk's office or hire a lawyer and save money in the long run,.

Your brother has to start the process of eviction. He goes to the local township court where the land is and files the paperwork for eviction. Once it's filed, and the paperwork is all in order, the sheriff will serve the man on the property eviction paperwork stating he has so much time (10 days, 15 days, 30 days whatever) to vacate the property. If they do not vacate, they run the risk of being arrested.

This is not a case of eviction. The man living on the property was the OWNER, not a RENTER and when his property was sold, has no rights whatsoever; he is not a tenant. He is now legally trespassing and your brother should go to the sheriff's office with the deed and inform them that someone is squating on his property. They will remove him.

Are you sure your brother did just buy a tax lien? He would have had to paid all liens and waited the redemption period to claim the land.

But assuming you are correct, your brother really does own the land, he has to follow the eviction laws. Starting with giving the guy a 60 day notice to move his trailer.

He will not be able to do anything outside of a court room of they guy does not move his trailer in the 60 days, but he can try to represent himself in court.

Hello friends

After such a big absence, it probably isn’t a surprise that I was considering taking a bloggy hiatus. I’ve just been feeling overwhelmed with work and life and getting ready for Israel and all. But I kind of missed my ramblings here and am back. For now. We’ll see.
I’ve been trying to write more about my experiences in the hospital which, I have to confess, remain very much with me. It is hard to believe, in a way, that it was really only 2 months of my life, over a year ago. The loss of control and, well, everything else in my life, sticks with me and flashes into my head at the oddest times. Memories of helplessness are still strong. The writing part isn’t going so well, though. I have lots else to do and I’m a huge procrastinator
